Medical Decision-Making for Incapacitated & Unrepresented Patients

COURSE DESCRIPTION

This webinar examines the complex bioethical and legal issues around medical decision-making in the incapacitated unrepresented person in the acute care hospital and skilled nursing facility settings, through a lens of current California practices and regulations. After a lengthy legal battle, Health & Safety Code 1418.8 (Epple) has been found constitutional, and the California Department of Aging is implementing a new Office of the Long-Term Care Patient Representative to help ensure a fair process for nursing home residents that does not require court intervention. Panelists are experienced bioethicists and clinicians with insights into the interdisciplinary team and bioethics committee processes through which important medical decisions are arrived at.

  • Describe current practices in California's acute care hospitals and skilled nursing facilities with respect to medical decision-making for incapacitated unrepresented patients
  • Identify the bioethical issues and standards of decision-making related to care of patients who lack decisional capacity and qualified surrogates
  • Respond to changing regulatory requirements for the care of incapacitated unrepresented patients in skilled nursing facilities under HSC 1418.8, in the context of legal challenges that have now been resolved
  • Promote an interdisciplinary team approach to decision-making for unrepresented patients

FACULTY

Karl Steinberg, MD, CMD
Stone Mountain Medical Associates, Inc.

Bio Dr. Karl Steinberg has been a nursing home, hospice, and home health agency medical director and chief medical officer in the San Diego area since 1995. He has board certifications in family medicine and in hospice and palliative medicine, and is certified as a nursing home and hospice medical director in addition to having a certification as a healthcare ethics consultant.  Dr. Steinberg serves as president of the National POLST organization, and is on the National Quality Forum’s standing committee on Geriatrics and Palliative Medicine. Dr. Steinberg is also on the Board of Directors of the San Diego County Medical Society and serves as a delegate to the AMA and California Medical Association’s House of Delegates. Dr. Steinberg is also an appointee to the California Insurance Commissioner’s Long-Term Care Insurance Task Force. Dr. Steinberg enjoys presenting at educational conferences to professional audiences and the public, and also serves as a consultant and testifying expert witness in civil lawsuits and regulatory matters. Dr. Steinberg is well known for taking his dogs on patient care rounds with him when circumstances permit.   

Chris Wilson, RN, JD, MS, HEC-C
Community Health Care Ethics

Bio Chris Wilson is an RN, Attorney, and Bioethicist who began her nursing career in long term care as a nursing assistant, followed by LVN, RN, and Director of Nursing. She is presently the founder and director of Community Healthcare Ethics, a non-profit organization dedicated to bringing bioethics resources to long term care. Chris has a master’s degree in Health Care Ethics from Creighton University, and is a certified Healthcare Ethics Consultant. In this capacity she provides advice and consultation to individuals, families, and healthcare providers. She is also a member of, and advisor to, several bioethics committees and is a frequent speaker for conferences and educational institutions regarding informed consent and bioethics issues.  

Lynette Cederquist, MD
Clinical Professor at UC San Diego Health System 

Dr. Cederquist is a hospice and palliative medicine specialist who helps relieve suffering in people with life-limiting and advanced illnesses. As a provider of palliative care, she aims to optimize comfort and quality of life while addressing the psychological, social, and spiritual concerns of patients and their families. Dr. Cederquist currently only sees patients with chronic pain who have been referred to her by internists at UC San Diego Health. As a professor in the Department of Medicine, Dr. Cederquist instructs medical students, residents and fellows at UC San Diego School of Medicine. She earned her medical degree from Oral Roberts University in Tulsa, Oklahoma. Dr. Cederquist is board certified in internal medicine and hospice and palliative medicine.

CONTINUING EDUCATION

Full attendance at the live webinar (you must attend a minimum of 50 minutes) is a prerequisite for receiving professional continuing education credit. Attendees requesting CE credit must each call into the webinar individually using the call-in number and computer link from your instruction email for your attendance to be documented. If you do not follow these directions, there is no official documentation of your attendance, and you will not receive CE credit for this webinar. Ask us about special arrangements offered to CCCC organization members.

You are also required to complete an online survey within 14 days following the webinar to receive a CE certificate or certificate of attendance. A link to the evaluation will be provided in an email sent to you within 48 hours following the webinar. The email will also include links to the presentation recording and slides. Certificates will be sent via email. 

Nursing: Provider approved by the California Board of Registered Nursing, Provider #CEP 15403, for one (1) contact hour.

Social Work: Course meets the qualifications for one (1) hour of continuing education credit for LMFTs, LCSWs, LPCCs and/or LEPs as required by the California Board of Behavioral Sciences. CCCC is approved by the California Association of Marriage and Family Therapists to sponsor continuing education for LCSWs and LMFTs, Provider #91987. 

Chaplains: This program may be used for continuing education credit for chaplains certified with the Board of Chaplaincy Certification Inc.
